3:00pm - 3:50pm UNDERSTANDING WCL SECTION 15(3)(W) AND THE APPLICATION OF THE “SAFETY VALVE” Christopher Whyland, Esq. (1 Areas of Professional Practice CLE Credit) In 2017 the legislature enacted a series of reforms to address the delays in permanency determinations that followed the 2007 reform legislation. To address these delays, the legislature amended the statute which included a poorly worded amendment to Section 15(3)(w). This presentation will look at the 2017 reforms and their impact on the durational cap placed on indemnity benefits. It will also look at how the Board has defined some of these concepts including the application of what they now call the “safety valve”.

Feuerstein, Esq., Hurwitz, Whitcher & Molloy (1 Areas of Professional Practice CLE Credit) OnBoard Limited Release is the Workers’ Compensation Board’s new platform for handling all medical treatment requests, including prior authorization of medications, durable medical equipment, treatment and diagnostic studies. This presentation will review the development and implementation of OnBoard Limited Release. It will also explore the differences between the present and past systems, potential issues with administration of this system and compare the Board’s theory of prior authorization to the actual practice providers deal with. It will also walk attorneys through the backend system used by providers in order to better assist providers unfamiliar with the new system. (1 Areas of Professional Practice CLE Credit)

We will also be discussing recent updates and trends to avoid when it comes to protecting Medicare’s interests.

(1 Law Practice Management CLE Credit) This presentation will provide a practical understanding of the medical guidelines for depression & PTSD. The pre-authorization process (PAR) will be discussed, examples of reviews will be presented along with a strategy to help injured workers receive the behavioral care they require. Specific recommendations will be made regarding presenting your client’s case at a hearing to maximize approval for treatment.
