This presentation will cover the following areas and how it affects law practices:
- Reviewing what are psychological injuries for injured workers
- Understanding the struggles that injured workers with psychological injuries face
- How were the new medical treatment guidelines developed?
- What do the new medical treatment guidelines mean for injured workers?
- What are the potential impact of the new medical treatment guidelines?
- How can we (therapists, doctors, lawyers, etc.) help and work to limit other stressors?

Dr. Sutee Techaratanaprasert, "Dr. T.", graduated with a Ph.D. in General Clinical Psychology from The Derner Institute at Adelphi University in 2014.  He is a Licensed Psychologist in New York State and coded by the Workers' Compensation Board to treat injured workers.  Dr. T. is a member of Psi Chi - An International Honor Society in Psychology,  the American Psychological Association and is clinically trained to treat children, adolescents, and adults.  His experience includes working in inpatient setting, hospital setting, residential program, outpatient mental health clinic, and in private practice; and he has worked in a supervisory role as a Clinical Director at an outpatient mental health clinic and oversaw the clinical work for over 80 therapists.  Dr. T. began working with Behavioral Medicine Associates in Dec 2017.

Dr. Michelle Dean has been treating injured workers for over 7 years for Behavioral Medicine Associates. Her main focus for the last few years has been with transit workers experiencing PTSD from their work incident. She has presented before at the IWBA and is looking forward to presenting with Dr. T and seeing everyone in person.

May It Please The Court – A practical approach to Appellate Advocacy before the 3rd Department

The purpose of the CLE is to educate and update IWBA members on: (1) the nuts and bolts on appeals to the 3rd Department, including mechanics of the process from beginning to end – Notice of Appeal, Extensions of time to perfect, record list and stipulation, the appellate brief, respondents brief, Notice of Entry, motions to reargue if decision is adverse, and motion to Court of Appeals; (2) Standards of review - including substantial evidence, arbitrary and capricious, abuse of discretion, error of law, etc. to determine if pursuit of court appeal is warranted/appropriate; and (3) practical tips on issue spotting, record development, brief writing and oral argument all in the context of evaluating cases to determine if pursuit of court appeal is warranted/appropriate.

Alex C. Dell is the founder of the firm, and has over twenty-six (26) years of experience in the areas of workers' compensation law and disability benefits law.  Alex represents injured and disabled workers who are in need of wage replacement and medical benefits. Alex's practice also includes representation of injured policemen, firemen and correction officers seeking benefits pursuant to New York's General Municipal Law Section 207-a and 207-c. Alex earned his B.A. with honors at the State University of New York at Binghamton, and his J.D. at Queens College School of Law of the City University of New York.  Alex frequently teaches attorneys who are interested in becoming more familiar with the area of workers' compensation, and regularly speaks to various labor union members about their rights under the New York State Workers' Compensation Law. Alex is admitted to practice before all New York State Courts, as well as the United States District Court for the Northern District of New York.  Outside of work, For over twenty-five (25) years, Alex served as a National Collegiate Athletic Association (NCAA) Division I Ice Hockey Referee. On January 23, 1992, Alex reffed his 1st National Hockey League (NHL) game between the Toronto Maple Leafs and the New York Islanders at the Nassau Colliseum in Uniondale, New York.   

Ed Obertubbesing has over 32 years of experience in the area of Workers’ Compensation Law. He is an attorney in the firm’s Workers’ Compensation Department, where he focuses his practice on handling appeals before the New York Workers’ Compensation Board and the Courts of New York State.  Ed graduated with honors from Delaware Law School of Widener University in 1988. Since admission to the New York Bar in 1989, Ed has worked extensively in the area of Workers’ Compensation, handling thousands of hearings and appeals before the Workers’ Compensation Board and dozens of appeals before the New York State Supreme Court Appellate Division and Court of Appeals. Prior to joining The Law Firm of Alex Dell, PLLC in 2019, Ed was on in-house counsel staff with the New York State Insurance Fund where he was extensively involved in the training and mentoring of attorneys and Hearing Representatives.

How Labor Market Attachment is Being Affected by COVID-19

We will discuss when labor market attachment is ripe for litigation and how in the past year the issue was held in abeyance.  However, now as restrictions are lifted on LMA the affect it is having on claimant’s.

Elan Hallhauser has been practicing workers’ compensation law for the past several years.  She recently switched firms in order to start a workers’ compensation division at a well-known personal injury firm. Elan focuses on helping injured workers obtain all their protected benefits under NY Workers’ Compensation laws.   She is currently working on a 3rd Department Appeal  dealing with the issues of timely notice and whether proper deference was given to credibility of witnesses by the Board Panel and Full Board.  Besides law, Elan loves to play tennis and travel, even though for the past year plus it has been difficult.

The Presumptions Under The Workers' Compensation Law

This presentation will examine both the specific and general presumptions set forth in the Workers' Compensation Law and whether those presumptions are generally recognized by the Judges and the Board and whether they are given the statutory weight that they warrant. The presentation will also examine whether the presumptions have eroded over time as the Board has adopted what appears to be a more carrier friendly agenda.

Brendan Quinn was born on Long Island and attended The State University of New York at Buffalo, where he graduated cum laude with a B.A. in English in 1980. His father, who spent his life in public service, and local government and politics influenced Brendan’s interest in law.  Brendan graduated from St. John’s University School of Law with a J.D. in 1986 and was admitted to the New York Bar, U.S. District Court, Northern District of New York in 1987. He is a member of the Saratoga County and New York State Bar Associations and the Injured Workers’ Bar Association. Brendan has been with BMCQ for more than 30 years and practices in the areas of workers’ compensation, longshoreman litigation, and no-fault litigation. 

Richard Frontero joined BMCQ because the smaller, more specialized firm affords him time to really listen and understand his clients’ needs.  After earning his Bachelors Degree from the University of Florida, Richard attended Albany Law School, where he graduated with honors. While working in the New York State Office of the Inspector General and learning more about worker’s compensation and disability law, he found his calling. Previously, Richard served in the Rensselaer County Public Defender’s office, as well as Walsh and Hacker, and Boies Schiller Flexner LLP, both in Albany. Richard, grew up in Staten Island, met his wife at the University of Florida, also an attorney, and moved to Albany to attend law school together. A “huge” Florida Gators fan, Richard says he also loves the Yankees and Jets.
