CURRENT OBSTACLES TO PHARMACY ACCESS FOR INJURED WORKERS IN NYS

This presentation will review the common rejections and pitfalls an injured worker faces at various stages of their workers’ compensation case – from initial date of injury to contested status to ultimate resolution. The NYS WCB Medical Portal authorization site, the NYS WCB Pharmacy Formulary, the NYS WCB medical treatment guidelines, the mandate for pharmacy benefit managers (PBMs) and strategies for receiving authorizations via the PBM systems will all be discussed as they relate to pharmacy access.
Mr. Rontiris has been a licensed pharmacist in New York and Florida for 28 years. In addition to his extensive retail and chain pharmacy experience, he has specialized in Workers’ Compensation Pharmacy for 25 years. He is currently President of Titan Pharmacy which has been dedicated to NYS Workers’ Compensation Pharmacy for 21 years. George resides in Manhasset, NY with his wife and three children.
Mr. Levis has been a licensed pharmacist in New York for 28 years. He is also licensed in California, Michigan and Texas. In addition to his extensive hospital and retail pharmacy experience, Peter has specialized in Workers’ Compensation Pharmacy for 21 years. Peter is currently Supervising Pharmacist of Titan Pharmacy which has been dedicated to NYS Workers’ Compensation pharmacy for 21 years. Peter resides in Bayside, NY with his wife and three children.

William Crossett, Esq. concentrates his practice in the representation of Injured Workers. Since 1982, he has appeared before the Workers’ Compensation Board and the Courts of New York. As an advocate for the Injured Worker, he has testified before the New York State Senate and has presented Continuing Legal Education programs. Mr. Crossett is a past President of the Injured Workers Bar Association of New York and is an active member of Workers Compensation Law Division of the New York State Bar Association. He is also an active member of the Workers’ Injury Law and Advocacy Group. In 2012, he was inducted as a fellow in the College of Workers Compensation Lawyers. Mr. Crossett practices throughout Central NY with offices in Syracuse, Watertown and Chittenango.
Louis M. Dauerer, Esq. began working for the Firm in 1990 while still in Law School. His astute legal acumen and diligent work ethic made him a natural fit to remain with the Firm and dedicate his legal his legal career to the advancement of the rights of injured workers. Lou is a lifelong Hudson Valley resident who graduated from Arlington High School. He holds degrees from Dutchess Community College (A.A.), State University of New York Binghamton (B.A.) and St. Johns University School of Law (J.D.). Lou is active in several organizations dedicated to assisting injured workers. He sits on the Board of Directors of the New York injured Workers Bar Association (as Past President) and is a founding member and one of the Directors of the New York Workers Compensation Alliance, a political action committee dedicated to protecting the rights of injured workers. He is a member of the Dutchess County Bar Association, the New York State Bar Association, the New York Injured Workers’ Bar Association, and the Workers Injury Law & Advocacy Group. Lou also serves on the Board of the non-profit Triangle Shirtwaist Factory Fire Memorial, which raises scholarship funds for the children of permanently injured and deceased workers.
Mary Ellen O'Connor, Esq. After earning her BS from SUNY Albany and her MS from the College of Mount St. Vincent, Mary Ellen became a K-2 teacher. She soon discovered that many of her young students with learning disabilities were unable to access the services they needed to succeed in the classroom. Their parents either didn’t know about the resources available or struggled to navigate the legal red tape that was required. Mary Ellen initially hoped that earning her law degree from CUNY School of Law would allow her to be a more effective advocate for children with special needs. Life took an unexpected turn, however. Although Mary Ellen entered law school with the goal of focusing on special education law, she soon became frustrated with the ineffectiveness of the system and how it was being manipulated by the wealthy to provide extra advantages for their children. After an extended period of soul-searching, she channeled her desire to help others into a focus on workers’ compensation benefits law and Social Security disability law.

Emily F. Janicz joined Lewis & Lewis, P.C. as a law clerk in 2010 while attending law school. Emily is currently the administrative partner and co-manager of the firm’s Buffalo and Niagara Falls Offices. A lifelong resident of Western New York, Emily earned her undergraduate degree in Business Administration – Registered Accounting Program with honors from the University at Buffalo in 2009. In 2012, Emily graduated with honors from the University at Buffalo School of Law. Emily practices in the areas of Workers’ Compensation, Social Security Disability, and Personal Injury. Currently, Emily serves on the Board of Directors of the Injured Workers’ Bar Association and the Board of Directors for the Workers’ Compensation Alliance; she previously served on the Advisory Council of the Workers’ Compensation Board. In addition, Emily serves proudly as the Deputy Town Attorney of her hometown – Newstead, New York.
Holly L. Schoenborn, Esq. is a proud life-long resident of Western New York. A first generation college graduate, she attended SUNY Binghamton. Holly graduated in 1999 with dual Bachelor’s Degrees in Philosophy and Political Science, and then went on to the State University of New York at Buffalo Law School. Upon finishing law school in 2002, Holly went to work for Christopher Galasso Esq. doing general practice work, however in January 2005, she moved to Gielowski Federice & Caliguiri, LLP, starting a career in the area of Workers’ Compensation Law, representing both injured workers and insurance carriers. Working on both sides of the table gave Holly great experience, but she found working for clients who had been affected by workplace injuries to be the most fulfilling. As a result, in 2006, she went to the law firm of Lewis & Lewis where she focused exclusively on representing injured workers. In 2013, Holly joined The Dolce Firm where she continues to assist hard working men and women who have suffered work place injuries.
