In 2017 the legislature enacted a series of reforms to address the delays in permanency determinations that followed the 2007 reform legislation.  To address these delays, the legislature amended the statute which included a poorly worded amendment to Section 15(3)(w).  This presentation will look at the 2017 reforms and their impact on the durational cap placed on indemnity benefits.  It will also look at how the Board has defined some of these concepts including the application of what they now call the “safety valve”.
